THE CONSTITUTION PART XIII - IMMIGRATION

"We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."

Amendment 14, Section 1 - "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

Whenever a question arises concerning an important issue such as immigration, the best and most reliable source for finding what this nation should do in solving any problem that we face is to look to the Constitution.

While there are only two specific references in the Constitution to immigration , stated in this most important of documents as , "Naturalization, " there is clear evidence by the Framers as to what they intended concerning the rights of the people who live in this country and how those rights effect immigrants.

The two references in the Constitution that specifically mention , "naturalization, " are found in Article I, Section 8 in creating the authority of the Congress, "To establish an uniform Rule of Naturalization." Thus from a Constitutional stand point it is the responsibility of Congress to establish all laws and rules of naturalization or immigration.

The second reference is located in the 14th Amendment shown above stating that , "All persons born or naturalized in the United States," are, "citizens of the United States and of the State wherein they reside."

The key thought in the 14th Amendment which along with several other provisions established in the Constitution shows that the intent of the Framers was that citizens of the United States whether born or naturalized are granted the rights and privileges that are available in America.

While Congress has the Constitutional authority to establish laws of naturalization or immigration they do not have the power create blanket legislation that allows non - citizens the rights of born or naturalized Americans.

The beginning of the Preamble of the Constitution states clearly who gives authority to the government and in whom the rights established in the Constitution belong to and they are," We the People of the United States."

The Framers clearly show that the laws governing this country as established in the Constitution and the rights that are available are for citizens of this land. Even the very Representation in our government from the President to the Congress are established that eligibility to hold public office is reserved for citizens only with the President required to be a natural born citizen of The United States and not a naturalized citizen.

Throughout the Constitution our rights are continually shown to be for citizens of the country, even when the word citizen is not specifically mention. The Preamble calling the establishment of the Constitution by, "We the people, " clearly indicates that each of the rights and privileges as recorded by the Framers are for the citizenry of this country.

This does not mean that those who immigrate to The United States are treated as second class people or that the laws that protect our citizens whether civil or criminal do not afford the same protections and freedoms to all whether citizen or immigrant.

But the rights that we have to vote, to speak freely, to worship as we will, to keep and bear arms, protection from illegal search and seizure, all are rights given by authority of the people for the people, the citizens of the land.

It then is also established that any of these rights that are afforded to non-citizens is also given by the authority of the people of The United States. Anyone who enters in or resides in this country has the privilege given by the authority of the people to share in our freedoms and rights. Citizenship though is not a right that is given nor the privileges of citizenship to any immigrant whether legal or illegal until they have been established by the laws of naturalization as Americans.

Birth gives Americans the right of citizenship but to those who immigrate citizenship must be given by the rule of law. The Framers made it very clear that the law must first be satisfied before the rights of citizenship are available. Each Constitutional reference to our rights and privileges are for the people who are the citizens only.

The Framers realized that once the freedoms and liberties that we have in this country became known to the world that The United States would become a melting pot of cultures and nationalities from all over the world. But they also understood the necessity of keeping our identity as Americans and in establishing a uniform rule of law for gaining citizenship in America and having as born and naturalized citizens the rights and privileges as an American!

The thing that burns me up most about this is my daughter-in-law came here from Germany legally, she has to wait years to become a citizen of the US, the rest of these people seem to be getting a free pass.

Now it's like she is sent to the back of the line.

The mother of one of my best friends from high school was an immigrant from Vietnam. She was married to an American serviceman so was granted temporary citizenship on that basis. After she applied for permanent citizenship, he passed away due to complications suspected to be from Agent Orange.

It took here a total of ten years and approximately $25,000 dollars to finally get her citizenship. She made her children aware that this was one of the happiest days of her life, when she was bestowed a fully legal status under the law.

Unfortunately, shortly after gaining her citizenship she was killed in a automobile accident when I was a senior in high school. She had only been a legal citizen for a few short years of here life in this country, but she made sure her children knew how important that status was. She operated a resturant and really believed in the American dream and our way of life.

This bill is an insult to her memory and the memory and sacrifice for all those who have gone before her. She tried for an entire decade to become a legal citizen to this country, worked hard, payed taxes and raised her children to love and appreciate everything their country has given to them. Both her children are very successful, one naturalized and one born American citizens. She and other like her came here to become Americans, not to live here as foriegn nationals and rape our nation.

This bill must die.

Listen you ninnys, the Constitution refers to becoming a United States Citizen, not am American Citizen. Nowhere does it say you are becoming a citizen of America in any of the paperwork. That is because it's impossible. America is a continent (rather two continents - ever here of pan-America?) You don't apply for citizenship of America. You apply for United States citizenship.

So you don't "gain" citizenship in America. Get it?

Reread every quote from the Constitution that KT posted. No where does the Constitution refer to citizenship of America.

And why is it that Jenn's husband, who had to come here with either a work visa or a tourist visa got to stay here and doesn't have to go back to England? Is it because he has a job? Is it because he married Jenn? Is it because of "fees?"

Look up the Vanity Fair bio...just for starters. By Evan Wright. It's all over the place. You can't miss it. The article, a bio profile on Dollard, features numerous interviews and quotes with Dollard himself. Dollard himself admits that he's a whoremongering, drug addled, woman hating, violence loving, porn freak, psychopath. Read Dollard's profile/bio, which he co-operated with, and sat for hundred's of hours of interviews. The guy's been in and out of every rehab and psych ward in the nation. According to his own admission.

The article, much of it is an interview with Dollard himself, is called "Pat Dollard's War On Hollywood." (Now, I've had to do your homework for you.)

Just a taste...Sargent John Callen, who was part of the troops whom were Dollard was embedded with, say's "His presence endangered many lives. I have no doubt he is insane." And that's just for starters. Now mind you, this is an article that Dollard co-operated with. Just read Dollard's own words.

But of course, you won't. Because then you'd have to admit the truth. That you don't know what you're talking about, and you certainly don't know WHO you're talking about. But you've dug yourself this deep, you might as well keep digging.

Oooo, then that means that Michelle Malkin, conservative talker on Fox, you know, your buddy? Should be deported, because, her parents came illegally from the Philippines, she was born here, making her an anchor baby, which allowed her parents to live here in the U.S.

I wonder if she would go for that? Maybe she should and lead by example. Heck, my mother came here legally from Japan, married my dad and did everything legally. Malkin's parents did not and you can verify that by her records, it's public record.

My friend and I were recently talking about the ubiquitousness of technology in our daily lives. Reading this post makes me think back to that discussion we had, and just how inseparable from electronics we have all become.


I don't mean this in a bad way, of course! Ethical concerns aside... I just hope that as technology further advances, the possibility of copying our memories onto a digital medium becomes a true reality. It's a fantasy that I dream about almost every day.

Hi Ken, I'm very much in favor of immigration reform and closing of the borders - but before you talk of 'the liberal lie', let's be honest in that the 14th Amendment was ratified in 1868, long after 'the framers' were dead and buried. So while I support the premise, you weaken your arguement with inaccuracies and a pre-sumption to know the feelings and intent of people who died centuries before you were born.

PS, all legal citizens of the USA are not called United Staters (they are Americans). The name of the country is America (more specifically, North America. That is why the A is included in our initials: USA. United States refers to its standing: United. I am proud to be an AMERICAN! Being an American has nothing to do with nationality, but has everything to do with what country one has chosen to become a citizen of. I believe this type of information is rather elementary and yet it is being discussed among adults??? Sad.
